3. Account Registration

To use certain features, you must create an account. You agree to:

You are responsible for all activity under your account.


4. Customer Responsibilities

By using Vox 5, you agree that you:
• Will not use the Services for illegal, harmful, or deceptive purposes
• Will comply with all applicable laws (TCPA, state recording laws, HIPAA if applicable)
• Will not attempt to reverse engineer, scrape, or misuse the platform
• Are responsible for verifying whether your use of AI voice agents complies with your local regulations


5. AI Voice Agents & Call Handling

You understand and agree that:
• Vox 5 AI agents act based on your configuration and instructions
• You are responsible for call content, prompts, responses, and outcomes
• We may monitor or review interactions for quality, troubleshooting, and fraud prevention
• AI output may be imperfect, hallucinate, or require human oversight


6. Data, Content & Ownership

You retain ownership of all content you upload, including call scripts, prompts, business information, and customer data (“User Content”).

By using our Services, you grant Vox 5 a non-exclusive license to:
• Process data to perform the service
• Improve model accuracy, routing, and performance (anonymized and aggregated)

We do not sell your data.


7. Payments & Subscriptions

Paid plans auto-renew unless canceled.
You authorize recurring charges to your payment method.

We may modify pricing with notice.
All payments are non-refundable unless otherwise stated.


8. Service Availability

We strive for high uptime, but we do not guarantee uninterrupted service. Vox 5 is not liable for outages, latency, or third-party provider downtime (OpenAI, Retell, Twilio, etc.).


9. Prohibited Use

You may not use Vox 5 to:
• Engage in spam calling or SMS spam
• Violate the Telephone Consumer Protection Act (TCPA)
• Collect or process data without required consent
• Conduct fraud, harassment, or deceptive practices

We may suspend accounts violating this policy.


10. Limitation of Liability

To the maximum extent permitted by law, Vox 5 is not liable for:
• Indirect, incidental, or consequential damages
• Loss of business, revenue, or profits
• Errors generated by AI models
• Misconfigured phone agents or scripts

Your sole remedy is to discontinue use of the Services.


11. Indemnification

You agree to indemnify and hold Vox 5 harmless from any claims arising from:
• Your use of the Services
• Your violation of laws or these Terms
• Your misuse of AI voice agents


12. Termination

We may suspend or terminate accounts for:
• Violation of these Terms
• Fraud or misuse
• Non-payment

You may cancel at any time through your account portal.


13. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.


14. Changes to Terms

We may update these Terms at any time. Continued use after changes constitutes acceptance.
